When is poker legal or illegal in Vietnam?.

Poker is not absolutely banned in Vietnam. But having a club, a buy-in, or a prize pool does not automatically make an activity legal. The key line is whether it is organized under the sports framework or has been turned into disguised gambling.

## When is poker legal?

According to the Ministry of Public Security’s response published on the Government Portal, poker was recognized as an intellectual sport under Decision No. 732/QD-BNV dated 16/7/2014, which allowed the establishment of the Bridge & Poker Sports Association of Vietnam. Poker events therefore must follow the sports-management framework, especially Circular 09/2012/TT-BVHTTDL.

In short, a poker event can be treated as legal only when it meets all of the following conditions:

1. It has the required approval from the competent authority.

2. The event is publicly announced through media channels.

3. It is organized only as a tournament, not as a cash game at the table.

4. Entry fees are used for event organization, prizes, and taxes in line with the law.

## When is poker illegal?

If players join for money, property, or goods; if the activity is a cash game using real money; or if chips are bought and then exchanged back into cash, the conduct can be treated as illegal gambling.

That can lead to enforcement under:

- Article 321 of the 2015 Criminal Code, as amended in 2017: gambling.

- Article 322 of the 2015 Criminal Code, as amended in 2017: organizing gambling or keeping gambling premises.

- Article 28 of Decree 144/2021/ND-CP: administrative penalties for illegal gambling that does not yet reach criminal liability.

- Is there a license or written approval for the event?

- Is it publicly announced, or only invitation-only?

- Is it a tournament or a cash game?

- Are the buy-in funds properly accounted for?

- Are the prize structure, taxes, and rules transparent?

## Conclusion

Poker can be legal if it is organized within the proper legal framework and for a legitimate sports purpose. But once it shifts into money-for-money play or becomes a disguised gambling room, the legal risk can move quickly from administrative penalties to criminal exposure.
